As AI continues to transform our lives at an unprecedented pace, the call for regulation is growing. In the recent UK General Election campaign, the Labour Party made promises to take legislative action to ensure AI safety, so there were rumours that today’s King’s Speech would reveal an AI Bill. We were not surprised that this turned out to be hype as there’s a long way to go before new legislation will be ready.
We’ve seen in the EU’s AI Act that rules, if drawn too tightly, struggle to adapt to innovations in the AI sphere. Whilst delaying regulation risks potential harm, a rush to regulate would inevitably be flawed and could stifle innovation. The UK’s approach to AI regulation is a tightrope walk, seeking to balance innovation, safety and ethical considerations.
Regulation is essential for several reasons. Firstly, it protects the public. We have seen over many years that AI systems can perpetuate biases, spread misinformation and even pose physical dangers. We need regulation to create safeguards, ensuring AI is used responsibly and for the public good. Secondly, it builds trust. For AI to reach its full potential, the public needs to trust it. Clear regulations can demonstrate that AI is being developed and deployed with due consideration for safety, fairness, explainability and transparency. Finally, regulation can promote innovation. Counterintuitive as it may seem, clear rules provide a framework for developers, encouraging responsible experimentation while mitigating potential risks. Every week we get calls from data scientists, developers and users of AI tools crying out for guidance about what they should – and should not – do.
However, rushing into regulation could have negative consequences. Overly restrictive or poorly conceived regulations could slow down AI development and hinder the UK’s ability to compete on a global stage. Rushing can also lead to regulations that fail to address the nuances of AI, potentially causing more harm than good. If regulations are seen as inadequate or reactive, public trust in both AI and the regulatory process could be eroded.

This involves engaging with experts from various fields, including technology, ethics, law and social sciences. But wider voices – non-experts – need to be heard too. AI is constantly evolving, so regulations need to be flexible and adaptable enough to keep pace with technological advancements, while still providing a stable framework for innovation. Additionally, the UK needs to collaborate with international partners to ensure a coordinated and effective approach to regulation.
